Domicile: The Concept That Follows You
States tax their domiciliaries — people whose permanent home is in the state — on worldwide income. Crucially, domicile continues until you affirmatively establish a new one. Moving abroad “temporarily” (in the state’s view) doesn’t end it. The burden of proving you left for good falls on you.
The Sticky States
Four states have earned their reputation: California, Virginia, South Carolina, and New Mexico. They interpret continuing ties aggressively — a driver’s license, voter registration, bank accounts, property, dependents in state schools, even a mailbox or storage unit can support a claim that you never really left. California’s Franchise Tax Board is particularly energetic about auditing departures.
The Easy States
Nine states have no income tax at all: Florida, Texas, Nevada, Washington, Wyoming, South Dakota, Alaska, Tennessee, and New Hampshire. Leaving from one of these — or establishing domicile in one before moving abroad — makes the state question disappear. This is why so many expats-to-be spend a few months “moving to Florida” first: it’s not a loophole, it’s clean domicile planning.

Sell or lease out your home — or at minimum, document that it’s no longer available to you.
Change your driver’s license and vehicle registration (surrender them, or re-establish in a no-tax state).
Update voter registration — vote absentee from your last state only in federal elections if it’s a sticky state.
Move financial accounts’ addresses; close safe deposit boxes.
Cancel state-linked memberships, professional registrations you don’t need, and in-state mail forwarding.
It’s fixable. The question is whether your state can plausibly claim continuing domicile — and the answer is factual: what ties remain, and what does your paper trail show? A one-time review of your exit is cheap insurance against years of disputed returns.
